This page contains two sets of Terms & Conditions: (1) for the sale of physical products – in English, and (2) for event tickets – in Polish
(1) TERMS OF SERVICE (PHYSICAL PRODUCTS)
Contract language: English. Translations (if provided) are for convenience only and do not change these Terms.
Scope of Terms
These Terms of Service apply exclusively to purchases of physical products (such as books, prints, and merchandise) made through our online store. They do not apply to the sale of tickets for events. Event ticket sales are governed separately by the Regulamin Sprzedaży Biletów na Wydarzenie (Event Ticket Sales Regulations), which is an original Polish-language contract and legally binding for ticket purchases. The “translations for convenience only” rule in these Terms does not apply to that document.
Welcome to Agata Serge Photography (“we”, “us”, “our”). We operate this website and online store (the “Services”), which are powered by Shopify. By visiting or using the Services you agree to these Terms of Service (the “Terms”) and our Privacy Policy available at https://agataserge.shop/policies/privacy-policy. If you do not agree, please do not use the Services.
Through the Services, we provide certain services electronically, including enabling you to place orders and conclude contracts of sale for the goods offered. These Terms govern your access to and purchases from the Services and set out the rules for using the store, placing orders, pricing and taxes, shipping and delivery, withdrawal/returns and defect handling, as well as other legal terms (intellectual property, disclaimers, liability and governing law). See Section 27 for our trader identity and contact details.
1. ACCESS & ACCOUNT
You represent that you are at least the age of majority in your place of residence and you consent to allow your minor dependents to use devices you own or control to access the Services. You agree to provide accurate, current, and complete information and to keep your account credentials secure. Accounts may not be sold, transferred, or licensed. Automated/bot account creation or access is prohibited.
Consumer definition. For these Terms, "consumer" means an individual acting wholly or mainly outside their trade, business, craft or profession.
2. OUR PRODUCTS
We try to display products accurately; however, colors and appearance may vary by device/settings. We do not warrant that any product will meet your expectations. Descriptions and availability may change without notice and we may limit quantities per person/household. No resale: purchases are for personal/household use only and not for commercial resale or export.
3. ORDERS
Offer & acceptance. When you place an order, you make an offer to buy. We may accept or decline your order in our discretion. Your order is accepted when we send an order confirmation e‑mail and after your payment is successfully processed. This does not affect any statutory rights of consumers in their home jurisdiction.
Pricing/availability errors. We may cancel all or part of an order before shipment if a product is mispriced or unavailable due to an obvious error. If we cancel, we will refund amounts you paid for the cancelled items.
Personal/household use. You represent your purchases are for your own personal or household use.
Standard orders (regular sales). Unless a product page says otherwise, orders are for in‑stock items and are processed promptly after payment authorization. We will send you an order confirmation. Once dispatched, you may receive a shipping update and/or tracking details from us or the carrier, where available. We may ship items in one or more parcels.
Order changes & cancellations. Because we begin processing quickly, we cannot guarantee changes or cancellations after checkout. If you need to modify or cancel, contact shop@agataserge.com immediately. If your order has not yet entered fulfillment, we’ll check if an update is still possible — we can’t guarantee it. Once a shipping label is created or the order is dispatched, changes (including address changes) are not possible.
Availability. All orders are subject to availability. If an item becomes unavailable after you place an order and before dispatch, we will cancel the affected item(s) and refund you in full. We do not accept backorders for regular sales unless expressly stated on the product page.
Quantity limits & anti‑scalping. We may limit quantities per person/household/order and refuse or cancel any order that, in our reasonable opinion, appears to be placed by resellers, dealers, or distributors.
Fraud screening. Orders may be refused, cancelled, or delayed if flagged by our or our payment partners’ fraud‑prevention systems. We may request additional verification to protect you and us.
Pre‑orders. We may offer one‑off pre‑orders for specific products. By placing a pre‑order, you authorize us to charge your payment method at checkout. Pre‑order details (window, planned dispatch/release date and any edition limit) are stated on the product page and/or at checkout; in case of any inconsistency, the product page prevails. Dates are estimates and may change. If the planned dispatch/release date changes by more than 14 days, we will email you the revised date; you may cancel at any time before dispatch for a full refund. This does not affect any statutory consumer rights.
Limited editions & drops (in‑stock). From time to time we may release time‑ or quantity‑limited products as in‑stock drops (not pre‑orders). These orders are processed upon payment authorization, like standard orders. Cart placement does not reserve stock; inventory is allocated only when payment is successfully completed and we issue an order confirmation. If simultaneous checkouts cause an oversell, we may cancel excess orders and refund in full. We may set per‑customer limits and refuse/cancel orders that, in our reasonable opinion, indicate resale/scalping activity. Limited items may not be restocked and we do not offer rain checks or backorders unless expressly stated on the product page.
Refunds/returns. Returns and refunds are governed by our Refunds & Returns Policy available at https://agataserge.shop/policies/refund-policy. Regional variations apply (see Section 22). Personalized items may be excluded from withdrawal rights where permitted by law; see the Refunds & Returns Policy for details.
4. PRICES, TAXES & BILLING
Unless stated otherwise, posted prices apply at the time of order and may differ from prices offered elsewhere.
Tax‑inclusive pricing by currency. We publish prices in PLN, EUR, and USD. The applicable product price is the one displayed for the currency you select (or that is assigned based on your shipping country). At checkout, the Subtotal equals that product price. It already includes any indirect taxes we are required to collect for your destination; where no tax collection obligation applies, the tax component is zero. Shipping is shown and charged separately and is paid by the customer.
Import charges not included. Any import duties, import VAT/GST, and customs brokerage charged at the border are not included in our prices or Subtotal (see Section 5 – Duties & import charges).
Currency & checkout. In supported markets we may display prices and charge you in your local currency. Where local‑currency checkout is available for your destination, your order will be charged in that currency and the Subtotal will reflect it. Where local‑currency checkout is not available, we may display prices in a local currency for convenience, but your order will be charged in PLN, EUR, or USD as clearly shown at checkout. Your bank or card issuer may apply its own exchange rate and fees. Your order confirmation/invoice will state the charge currency.
Billing. You authorize charges to your selected payment method for the order total, including shipping and any taxes shown at checkout.
5. SHIPPING, DELIVERY & PASSING OF RISK
Any delivery time we state is an estimate only and is not guaranteed. If no delivery time is stated:
- EU/UK consumers: we aim to deliver as quickly as possible; if no time is stated, we will deliver within 30 days of order confirmation.
- US & Rest of World: we aim to dispatch as quickly as possible; if no time is stated, we will dispatch within 30 days of order confirmation.
Pre‑orders ship on the date shown on the product page (see Section 3 for changes to pre‑order dates).
We are not liable for delays caused by carriers, customs, or events beyond our control.
Shipping origin & fulfillment. Orders ship from Poland. We may use third‑party logistics providers. Carrier selection is at our discretion; service availability may vary by destination. Your contract remains with Agata Serge Photography.
Address restrictions. We can’t deliver to P.O. boxes, Packstations or parcel lockers.
Loss or damage on delivery (claims). Please inspect your order upon receipt and contact zwroty@makanalogistyka.pl within 7 days of delivery if the package or items are missing, damaged or incorrect. Please include photos of the outer box, inner packaging and the item(s). Keep all packaging until the claim is resolved. This notice period does not limit statutory rights available to EU/UK consumers. For full instructions and timelines, see our Refunds & Returns Policy.
Undeliverable/Refused parcels. If a parcel is returned to us due to refusal, failed delivery or incorrect/insufficient address, the original shipping fee is non-refundable and reshipment costs are payable by the customer (without prejudice to mandatory EU/UK withdrawal refunds).
Passing of title & risk:
- EU/UK consumers: Title passes upon delivery. Risk of loss transfers only when you (or a person you nominate) take physical possession of the goods, unless you arranged the carrier yourself.
- US & Rest‑of‑World: Title and risk pass when we hand the goods to the carrier.
Duties & import charges. International shipments outside your customs area may be sent DAP/DDU. You are the importer of record and are responsible for import VAT/GST, duties, brokerage and clearance fees. We cannot control customs delays. We declare the actual transaction value and cannot mark shipments as “gift” or under‑declare value.
We may ship orders in multiple parcels at no additional product cost. If delivery is refused or fails due to an incorrect address or failure to collect, we may charge the costs of reshipment and any return charges from the carrier.
6. INTELLECTUAL PROPERTY
All content in the Services — including trademarks, text, images, audio/video and the overall layout — is owned by us or our licensors and protected by IP laws. Buying a physical book doesn’t grant a license to reproduce, scan, digitize, distribute, publicly display or create derivative works from the book’s content. All rights not expressly granted are reserved.
Without our prior written consent, you may not:
- post scans or photos of readable full pages/spreads (including page‑flip videos) or otherwise reconstruct the book’s content online;
- make or distribute prints or other reproductions of the images, or materially alter them beyond incidental, platform‑standard adjustments;
- remove or alter watermarks, copyright notices or metadata, or circumvent any technical protection measures;
- frame, hotlink or otherwise display our content so that it appears hosted by or affiliated with another site;
- upload our images to platforms whose terms would grant them a broad license to reuse or sub‑license the content (this does not restrict platform‑native re‑shares of our own posts);
- use any of our content (including crops/thumbnails/parts) to create or enrich datasets/embeddings or for machine‑learning/AI training, fine‑tuning, inference or evaluation;
- mint, tokenize or sell NFTs or similar tokens based on our content;
- use the names, images or likenesses of depicted individuals to imply endorsement, or for advertising or other commercial purposes.
Nothing in these Terms limits any mandatory exceptions under applicable law (e.g., fair use/fair dealing where they apply).
UGC. You may share non‑commercial images of the book as an object and short clips that do not reveal readable full pages/spreads. Do not suggest endorsement by us or any depicted person. For other uses, please obtain our written consent.
7. OPTIONAL TOOLS
You may access third‑party tools at your own risk. They are provided "as is" and "as available" without warranties. We have no liability arising from their use.
8. THIRD‑PARTY LINKS
Links to third‑party sites are provided for convenience. We do not control and are not responsible for third‑party content or practices. Review third‑party terms and policies before transacting.
9. RELATIONSHIP WITH SHOPIFY
Agata Serge Photography is powered by Shopify, which enables us to provide the Services. However, sales are made directly by Agata Serge Photography. Shopify is not responsible for your purchases. You expressly release Shopify and its affiliates from claims arising from or related to your transactions with us.
10. PRIVACY
Personal information is handled per our Privacy Policy at https://agataserge.shop/policies/privacy-policy and, to the extent applicable, Shopify’s privacy policy. Because the Services are hosted by Shopify, information you submit may be processed outside your country of residence. See our Privacy Policy for details on GDPR/UK GDPR compliance and international transfers.
11. FEEDBACK
If you submit reviews, ideas, or suggestions ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty‑free license to use and display such Feedback in any medium for any purpose. You warrant you have rights to the Feedback and that it does not violate third‑party rights. We may moderate or remove Feedback at our discretion and are not obliged to use or respond to it.
12. ERRORS, INACCURACIES & OMISSIONS
We reserve the right to correct errors or omissions (including pricing, availability, shipping charges, and transit times) and to cancel orders affected by such errors prior to shipment, with a full refund of any amounts paid for the cancelled items.
13. PROHIBITED USES
You may use the Services only for lawful purposes. You may not: violate laws; infringe IP rights; harass or harm others; transmit malware; send spam; impersonate others; scrape or crawl without permission; circumvent security; or use the Services for resale or commercial exploitation.
14. TERMINATION
We may suspend or terminate access at any time. You remain liable for amounts due up to the termination date. Sections that by their nature survive termination shall continue to apply.
15. DISCLAIMERS
Except as expressly stated by us, the Services and all products are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement. Nothing in these Terms limits or excludes your statutory consumer rights (including EU/UK legal guarantees of conformity for goods) where such rights apply.
16. STATUTORY GUARANTEES (EU/UK) & DEFECTS
EU/UK consumers. Goods are covered by the statutory legal guarantee of conformity. If your item is damaged, faulty or non‑conforming, contact zwroty@makanalogistyka.pl. We will provide the remedies required by law (repair or replacement; if not possible or not done within a reasonable time, price reduction or refund). Nothing in these Terms limits these rights. See our Refunds & Returns Policy for the procedure and timelines.
Outside EU/UK. Defects or damage‑on‑arrival (DOA) are handled per Section 22 (regional policies) and our Refunds & Returns Policy.
17. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS).
EU/UK consumers: We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of your statutory consumer rights. Our aggregate liability for losses relating to each order will not exceed the amount you paid for that order.
US & Rest‑of‑World: To the extent permitted by law, our aggregate liability arising out of or relating to the Services shall not exceed the amount you paid for the product giving rise to the claim.
18. INDEMNIFICATION
You agree to indemnify and hold harmless us, Shopify, and our respective affiliates and personnel from claims and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or violation of law or third‑party rights.
19. SEVERABILITY
If any provision is unlawful or unenforceable, it shall be enforced to the maximum extent permitted and the remainder will continue in effect.
20. WAIVER; ENTIRE AGREEMENT
Failure to enforce any provision is not a waiver. These Terms and any policies posted on the Services constitute the entire agreement and supersede prior understandings.
21. ASSIGNMENT
You may not assign your rights or obligations without our prior written consent. We may assign or transfer these Terms without notice.
22. GOVERNING LAW & DISPUTES; REGIONAL VARIATIONS
EU/UK Consumers. You benefit from any mandatory consumer protection laws of your country of residence, and you may bring proceedings in the courts of your residence.
Rest of World Consumers. These Terms are governed by the laws of Poland, without regard to conflicts rules. The courts of Poland have non-exclusive jurisdiction, and you may also bring a claim in your local small-claims court where the rules allow. This is without prejudice to any mandatory consumer protection laws of your country of residence.
B2B. For business customers, these Terms are governed by the laws of Poland and the courts in Poland shall have exclusive jurisdiction.
EU Online Dispute Resolution (ODR). Consumers in the EU may use the ODR platform at https://ec.europa.eu/consumers/odr . Our contact e‑mail: shop@agataserge.com.
Regional return rules are set out in our Refunds & Returns Policy.
23. FORCE MAJEURE
We are not responsible for any delay or failure to perform due to events beyond our reasonable control, including natural disasters, extreme weather, fire, flood, epidemic or pandemic (including public‑health measures), war, terrorism, civil unrest, embargoes, labor disputes, carrier strikes, supply‑chain disruptions, utility or telecommunications outages, and governmental actions. Performance will be deemed suspended for the duration of such event. This does not limit mandatory consumer rights. If a force‑majeure event continues for more than 60 days, either party may cancel undelivered items for a refund.
24. EXPORT & SANCTIONS COMPLIANCE
You agree to comply with applicable export control and sanctions laws and regulations. You represent that you are not located in, under the control of, or a national or resident of any country or person subject to embargoes or sanctions, and you will not use the Services to ship or resell goods in violation of such laws. We may refuse or cancel orders or shipments where required to comply with such laws.
25. ELECTRONIC COMMUNICATIONS
You consent to receive order‑related communications (including confirmations, invoices, and notices) electronically via e‑mail or through the Services. Electronic communications satisfy any legal requirement that such communications be in writing. Please keep your e‑mail address current; notices are deemed received when sent to your last provided address.
26. CHANGES TO THESE TERMS
We may update these Terms from time to time. If we make material changes, we will notify you as required by law (for example, by email or a notice on the site) and state the effective date. Unless a later date is specified, changes take effect when posted. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms. Changes do not affect contracts concluded before the change.

(2) TERMS OF SERVICE (EVENT TICKETS)
If you purchase tickets to an event, the sale and participation are governed solely by the Regulamin Sprzedaży Biletów na Wydarzenie (available below).
REGULAMIN SPRZEDAŻY BILETÓW NA WYDARZENIE
Zakres zastosowania
Niniejszy Regulamin dotyczy wyłącznie sprzedaży biletów na wydarzenia organizowane przez Agata Serge Photography. Nie ma on zastosowania do sprzedaży produktów fizycznych (np. książek, wydruków, gadżetów), która regulowana jest odrębnymi Terms of Service (dostępnymi powyżej).
1. POSTANOWIENIA OGÓLNE
1. Niniejszy regulamin („Regulamin”) określa zasady sprzedaży biletów na wydarzenia organizowane przez Agata Serge Photography („Organizator”) za pośrednictwem sklepu internetowego dostępnego pod adresem https://agataserge.shop, wyłącznie w zakresie sprzedaży biletów na wydarzenia (nie dotyczy sprzedaży produktów fizycznych).

3. Regulamin jest integralną częścią umowy sprzedaży biletu zawieranej pomiędzy Kupującym a Organizatorem.
4. Każdy Kupujący zobowiązany jest do zapoznania się z Regulaminem przed dokonaniem zakupu.
2. DEFINICJE
1. Bilet – potwierdzenie zakupu przesłane Kupującemu drogą mailową po dokonaniu transakcji, które uprawnia do udziału w Wydarzeniu.
2. Kupujący – osoba fizyczna lub podmiot dokonujący zakupu Biletu w sklepie internetowym.
3. Uczestnik – osoba, której dane zostały wpisane na listę uczestników; Uczestnikiem może być Kupujący lub inna osoba wskazana zgodnie z §4 ust. 9.
4. Wydarzenie – spotkanie autorskie, wykład lub warsztat organizowany przez Organizatora, którego szczegóły (miejsce, data, godzina) podane są w opisie na stronie sklepu.
3. ZASADY SPRZEDAŻY BILETÓW
1. Sprzedaż Biletów odbywa się wyłącznie online za pośrednictwem sklepu internetowego.
2. Cena Biletu jest podana w złotych polskich i zawiera wszystkie obowiązujące podatki.
3. Płatność za Bilet odbywa się w formie bezgotówkowej za pośrednictwem udostępnionych metod płatności.
4. Zawarcie umowy następuje z chwilą skutecznego zaksięgowania płatności i wysłania do Kupującego potwierdzenia zakupu. Potwierdzenie zakupu stanowi Bilet i uprawnia Kupującego/Uczestnika do udziału w Wydarzeniu.
5. Na listę uczestników wpisywane są dane osoby podane przez Kupującego podczas składania zamówienia. Bilety nie są wysyłane w formie papierowej.
6. Kupujący jest zobowiązany do podania prawidłowych i zgodnych z rzeczywistością danych.
7. Kupujący, który chce otrzymać fakturę VAT, zobowiązany jest do podania danych do faktury podczas składania zamówienia lub do niezwłocznego kontaktu z Organizatorem na adres e-mail: shop@agataserge.com; faktura jest wystawiana zgodnie z obowiązującymi przepisami.
8. Organizator może wprowadzić ograniczenie liczby Biletów możliwych do zakupu w jednym zamówieniu oraz stosować zabezpieczenia antyodsprzedażowe.
4. ZASADY UCZESTNICTWA
1. Wejście na Wydarzenie odbywa się na podstawie listy uczestników sporządzonej przez Organizatora, zgodnie z danymi podanymi przez Kupującego przy składaniu zamówienia.
2. Organizator zastrzega sobie prawo do weryfikacji tożsamości uczestnika na podstawie dokumentu tożsamości.
3. Bilet jest imienny i uprawnia do udziału jednej osoby w Wydarzeniu.
4. Kupujący/Uczestnik zobowiązuje się nie udostępniać, nie kopiować ani nie przekazywać swojego Biletu (potwierdzenia zakupu) osobom trzecim bez zgody Organizatora.
5. W przypadku próby wykorzystania tego samego Biletu przez więcej niż jedną osobę, pierwsza osoba, która zostanie zweryfikowana na liście uczestników i wpuszczona na teren Wydarzenia, uznawana jest za uprawnioną. Kolejne osoby posługujące się tym samym Biletem nie zostaną wpuszczone.
6. Organizator nie ponosi odpowiedzialności za szkody wynikłe z udostępnienia Biletu osobom trzecim przez Kupującego/Uczestnika.
7. Uczestnik zobowiązuje się do przestrzegania zasad bezpieczeństwa oraz stosowania się do poleceń Organizatora i obsługi miejsca Wydarzenia.
8. Organizator może odmówić wstępu lub usunąć z Wydarzenia osoby zachowujące się w sposób agresywny, nietrzeźwe lub naruszające porządek, bez prawa do zwrotu ceny Biletu.
9. Zmiana danych Uczestnika jest możliwa po wcześniejszym kontakcie z Organizatorem na adres e-mail: shop@agataserge.com, nie później niż 7 dni przed planowanym terminem Wydarzenia; po tym terminie Organizator może odmówić zmiany.
10. Udział osób niepełnoletnich jest dopuszczalny wyłącznie pod opieką rodzica/opiekuna prawnego albo za jego pisemną zgodą.
11. Uczestnicy mogą wykonywać krótkie nagrania lub zdjęcia do celów prywatnych i publikacji w mediach społecznościowych, natomiast nagrywanie całości Wydarzenia lub jego znaczących fragmentów wymaga zgody Organizatora.
12. W trakcie Wydarzenia mogą być wykonywane zdjęcia i nagrania wideo przez Organizatora w celach dokumentacyjnych i promocyjnych (np. media społecznościowe). Udział w Wydarzeniu jest równoznaczny z wyrażeniem zgody na nieodpłatne utrwalenie i rozpowszechnianie wizerunku w powyższym zakresie; Uczestnik może zgłosić sprzeciw przed rozpoczęciem Wydarzenia.
13. Spóźnienie na Wydarzenie nie stanowi podstawy do zwrotu ceny Biletu.
14. W przypadku szczególnych potrzeb związanych z dostępnością prosimy o wcześniejszy kontakt na shop@agataserge.com.
5. ZWROTY I ZMIANY WYDARZENIA
1. Zgodnie z art. 38 pkt 12 ustawy o prawach konsumenta, Kupującemu nie przysługuje prawo odstąpienia od umowy w przypadku zakupu Biletu na wydarzenie, które odbywa się w oznaczonym dniu i miejscu.
2. Zwrot Biletu możliwy jest wyłącznie w przypadku odwołania Wydarzenia przez Organizatora lub znacznej zmiany jego warunków, tj. przeniesienia na inny dzień lub do innego miasta.
3. W razie przeniesienia Wydarzenia zgodnie z ust. 2, Bilet zachowuje ważność na nowy termin/miejsce; Kupujący może jednak wybrać zwrot ceny Biletu zamiast uczestnictwa.
4. Zwrot ceny Biletu następuje tą samą metodą płatności, w terminie do 14 dni od poinformowania o zmianie/odwołaniu i otrzymania zgłoszenia zwrotu od Kupującego.
5. Organizator zastrzega sobie prawo do zmiany godziny rozpoczęcia Wydarzenia, programu lub innych elementów organizacyjnych, jeżeli nie wpływa to istotnie na możliwość uczestnictwa w Wydarzeniu; takie zmiany nie stanowią podstawy do zwrotu Biletu.
6. Organizator zwraca wyłącznie cenę Biletu; nie ponosi odpowiedzialności za inne koszty poniesione przez Kupującego (np. dojazd, nocleg).
7. Zgłoszenie zwrotu należy przesłać na shop@agataserge.com, podając numer zamówienia i dane Kupującego.
6. ODPOWIEDZIALNOŚĆ
1. Organizator nie ponosi odpowiedzialności za rzeczy osobiste pozostawione na terenie Wydarzenia.
2. Kupujący/Uczestnik ponosi odpowiedzialność za wszelkie szkody przez niego wyrządzone w trakcie Wydarzenia.
3. Organizator nie ponosi odpowiedzialności za przerwy lub zakłócenia w przebiegu Wydarzenia spowodowane przyczynami od niego niezależnymi (w szczególności awaria, decyzje właściciela miejsca, działania władz).
4. Odpowiedzialność Organizatora wobec Kupującego jest ograniczona – w najszerszym dopuszczalnym przez prawo zakresie – do wysokości ceny zakupionego Biletu i nie obejmuje utraconych korzyści; postanowienie to nie wyłącza odpowiedzialności za szkodę wyrządzoną umyślnie ani innych odpowiedzialności, których wyłączenie lub ograniczenie jest niedopuszczalne na mocy bezwzględnie obowiązujących przepisów prawa.
7. DANE OSOBOWE
1. Administratorem danych osobowych Kupujących/Uczestników jest Organizator.
2. Dane osobowe przetwarzane są w celu: realizacji umowy sprzedaży Biletu i umożliwienia udziału w Wydarzeniu (art. 6 ust. 1 lit. b RODO) oraz w prawnie uzasadnionym interesie Organizatora (art. 6 ust. 1 lit. f RODO) – m.in. zapewnienia bezpieczeństwa i dochodzenia roszczeń.
3. Odbiorcy danych: podmioty świadczące usługi płatności, hosting/IT oraz inne podmioty przetwarzające dane na zlecenie Organizatora.
4. Okres przetwarzania: przez czas niezbędny do realizacji umowy oraz do upływu terminów przedawnienia roszczeń.
5. Prawa osoby, której dane dotyczą: dostępu, sprostowania, usunięcia, ograniczenia, sprzeciwu, przenoszenia danych oraz skarga do Prezesa UODO.
6. Szczegóły przetwarzania danych określa Polityka Prywatności dostępna na stronie sklepu.
8. POSTANOWIENIA KOŃCOWE
1. W sprawach nieuregulowanych w Regulaminie mają zastosowanie przepisy prawa polskiego, w szczególności Kodeksu cywilnego i ustawy o prawach konsumenta.
2. Regulamin dostępny jest na stronie internetowej sklepu w sposób umożliwiający jego odczytanie, utrwalenie i zapisanie przez Kupującego.
3. Sądem właściwym do rozpoznania sporów jest sąd powszechny właściwy według przepisów prawa.
4. Regulamin wchodzi w życie z dniem opublikowania na stronie internetowej.
5. Organizator zastrzega sobie prawo do zmiany Regulaminu z ważnych przyczyn prawnych, organizacyjnych lub technicznych; zmiany obowiązują od chwili opublikowania i nie wpływają na prawa Kupujących, którzy dokonali zakupu przed wejściem zmian w życie.
6. Nieważność lub bezskuteczność któregokolwiek postanowienia Regulaminu nie wpływa na ważność pozostałych postanowień (klauzula salwatoryjna).
7. Informacja o pozasądowych sposobach rozstrzygania sporów: konsument może skorzystać z unijnej platformy ODR (Online Dispute Resolution) lub z pomocy właściwych stałych polubownych sądów konsumenckich; szczegóły w Polityce Prywatności.
POSTANOWIENIA UZUPEŁNIAJĄCE
W zakresie sprzedaży biletów niniejszy Regulamin ma charakter wiążący i nie stanowi tłumaczenia Terms of Service - Physical Products. Regulamin sporządzony jest w języku polskim i podlega prawu polskiemu. W sprawach dotyczących zakupu produktów fizycznych zastosowanie mają wyłącznie Terms of Service - Physical Products.
